Perspectiva General

Kyra A. Buch’s practice includes experience with matters related to leaves of absence (including FMLA and state equivalents), disability accommodation under the ADA and state equivalents, and other forms of paid and unpaid leaves. Kyra has helped both small and national companies develop policies and procedures related to leave law, provided advice and counsel on individual matters, and assisted with crossover issues that often arise between workers’ compensation laws and the ADA.

Kyra has an expanding emphasis in workplace safety, particularly handling OSHA audits and citations. She advises clients on overlapping issues related to both workplace safety and workers’ compensation, and works heavily within the firm’s COVID-19 Task Force and Vaccination Working Group. The group provides local, state, and national advice on interpretation of COVID-related laws and regulations as well the practicalities of implementing these laws.

A significant number of her clients include professional sports organizations who are looking not only for an explanation of what the law requires but also for the practical and logistical considerations of implementing certain practices. More so, these clients must also consider how certain actions or policies will be viewed by the public and/or the media. Kyra understands the need to problem solve while considering each of these client’s concerns.

Kyra spends roughly half of her time as a litigator, primarily focusing on single plaintiff litigation defending claims such as retaliation, discrimination, wrongful termination, failure to accommodate, and harassment. The other half of her practice consists of advice and counsel work creating policies and procedures for clients and advising on individualized inquires for employees.

She began her practice defending workers’ compensation claims and advising management clients on the same.
