New Law on Remote Work
New Legislation Enacted
Author: Aki Tanaka, Attorney at Law – Littler Mendelson, P.C.
The Romanian parliament adopted on February 28, 2018, a draft bill that regulates remote work. The new law only needs the President’s signature to come into force. The bill includes obligations to include certain specific clauses in employment contracts such as: the place/places where telework is going to be performed, the time tracking manner, responsibilities of the parties, and including in relation to labor health and safety, among other things. The law also allows the labor authorities, as well as the trade union/the representatives of the employees, to inspect remote employees’ homes to see if they meet the labor security norms.
