Author: Franchesca Abigail C. Gesmundo, Associate — Angara Abello Concepcion Regala & Cruz
The National Labor Relations Commission (NLRC) (sitting en banc) recently clarified that, within the context of disputes undergoing mandatory conciliation-mediation, the prescriptive period for filing a complaint for compulsory arbitration shall be interrupted upon the filing of a Request for Assistance under SENA and shall resume upon receipt by the requesting party of the referral issued by the SENA Desk Officer.
